Once, when dealing with the withdrawal of the client’s contract qualification deficiency, the team had conflicting opinions on whether to make up for other problems found in the consultant’s contract at the same time. After extensive discussion and in-depth communication with the client’s senior management, the team finally chose to manage and control without making up. Professionally, it seems that the lawyer gave up his position, But in fact, the lawyers used management methods to retain business opportunities for clients.

In the daily service, lawyers will encounter a large number of service needs for renewal and template contract review. If they only stick to the form from a professional point of view, although they negotiate with each other professionally, the service effect may be greatly reduced. Therefore, as a lawyer, sometimes it is necessary to maintain the current status of customers’ legal affairs without significant influence, Find a solution that can be accepted by all parties without affecting the substantive plane.

Chapter 2Adherence to the law is the duty of a lawyer, and at the same time, the vision should be expanded beyond the main line of law

When dealing with the bidding of engineering projects of clients, it was also found that there was inconsistency in the implementation of bidding in the same industry. Therefore, lawyers should be good at providing enterprises with localized and differentiated services, and should not be complacent. In risk assessment, they also need to judge and consider the enterprise’s risk bearing capacity, industry development trend and other dimensions</ strong>

Recently, when handling the well-known trademark infringement lawsuit for the consultant unit, I also had this experience. In this case, there were both the fact that the defendant infringed the plaintiff’s trademark right, and the plaintiff’s business needs to establish a company consistent with his well-known trademark in the jurisdiction. Legally, there is little doubt that the plaintiff will win the lawsuit, but it may not be able to finally achieve its business purpose,

Accordingly, lawyers not only need to provide services for customers in the court environment, but also need to cooperate with the court to provide services for customer units with government departments, and find a seamless way to connect the name transfer between the customer unit and the defendant. The case was once deadlocked, and finally through the mediation of the court, the expected differences between the two parties were settled in the middle. As a result, although the plaintiff gave up obtaining damages for infringement, it won the more expected business results.

During the service process, the customer was also lucky to participate in the manufacturer evaluation conducted by the customer unit. Compared with the well-known suppliers and the cheapest suppliers in the industry, the customer unit finally chose the supplier that the evaluation personnel believed had no chance of winning before the evaluation.

As far as the competitive negotiation process is concerned, the bid winning suppliers actually have no special advantages in individual items, but the secondary advantages of each item make up for the outstanding disadvantages of other competitive manufacturers, reflecting a comprehensive advantage.
